General terms of sale applicable in the pakker.com online store

1. Scope of the Regulations

These regulations apply to all orders placed through our online store. The offer of our online store is intended exclusively for Consumers. A Consumer, in accordance with Article 22 of the Civil Code, is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity.

2. Conclusion of the Contract

The sales contract is concluded with Pakker Trousers Sp. z o.o. The presentation of products in our online store constitutes an offer to conclude a sales contract. To conclude a contract, you must add the selected products to the shopping cart and place an order. The shopping cart and data entered in the forms can be modified before placing the order using the available functionalities and messages displayed during the ordering process. By clicking the button confirming and finalizing the order on the order summary page, you place a binding order for the products in the shopping cart. The sales contract is concluded when your order is received and registered in our online store's IT system. After placing the order, you will receive an email from us confirming the order and conclusion of the contract.

3. Language and Contract Recording Rules

The sales contract can be concluded in Polish or English. We retain the content of the contract and send you the order details and our Regulations by email. You can also check information about your orders through your customer account. The Regulations are also available on our online store website in a way that allows you to obtain, reproduce and record the content.

4. Product Delivery

Shipping costs must be added to the indicated product prices. Ordered products are delivered by courier companies cooperating with us. Detailed information about possible delivery methods and times as well as shipping costs are presented during the ordering process and on our store website. Products offered in the store are sold exclusively by mail order. Unfortunately, personal pickup is not possible.

5. Payments

The following payment methods are available in our online store: electronic payments (e-payments) through an online payment service. Detailed information about possible payment methods, including online payment services integrated with our store and available types of e-payments as well as any additional costs, are presented during the ordering process and on our store website in a special information tab regarding payment methods.

6. eReceipts

An eReceipt is a fiscal document in electronic form, compliant with applicable regulations. To receive an eReceipt, the Customer must consent to its issuance and delivery method by accepting the terms and conditions of our store. This consent is given during the ordering process. The eReceipt is issued to the Customer through the electronic fiscal receipt system and repository. In case of problems accessing the eReceipt, the Customer should check the spam folder and contact the Seller.

7. Right to Withdraw from the Contract

Consumers have the statutory right to withdraw from the contract within 14 days without giving any reason. The right to withdraw from the contract also applies to natural persons concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for these persons. Detailed information can be found on the "Right to Cancel" page.

8. Complaints: Conformity of Goods with the Contract / Defects

We are obliged to deliver goods without defects. In case of non-conformity of goods with the contract, the Consumer is entitled to rights specified in Chapter 5a of the Consumer Rights Act. Under the rules specified therein, the Consumer may request repair or replacement of goods non-conforming with the contract, or submit a statement of price reduction or withdraw from the contract. We are liable for non-conformity of goods with the contract revealed within 2 years of delivery. Complaints are processed immediately, no later than within 14 days of receipt.

9. Gift Cards (Vouchers)

The Pakker Trousers Gift Card (voucher) entitles its holder to pay for all products available in the pakker.com online store. The voucher has a monetary value – its value is determined at the time of purchase. It is not personalized, which means that anyone who has its code can use it. The voucher is indefinite and does not expire over time. It cannot be exchanged for cash in whole or in part.

10. Services Provided Electronically

To use our online store, including browsing the assortment and placing orders, you need a multimedia device with an installed web browser and access to the Internet and email. It is recommended to enable JavaScript scripts and Cookies in browser settings. Users are obliged to use the online store in accordance with the law and good practices.

11. Code of Good Practices

We have voluntarily submitted to the "Trusted Shops Quality Criteria".

12. Out-of-Court Dispute Resolution

We inform you that Consumers have the option to use out-of-court complaint handling and claim pursuit. Information on how to access the above procedure and dispute resolution procedures can be found at: www.uokik.gov.pl in the "Amicable resolution of consumer disputes" tab. Additionally, at: http://ec.europa.eu/consumers/odr Consumers have access to the online consumer dispute resolution platform (the so-called ODR platform).
